Planned Parenthood States Amendment 3 Provides a Right to Transport Minors Out of State for Abortions without Parental Consent

On Thursday, Missouri Attorney General Andrew Bailey issued a press release after lawyers for Planned Parenthood Great Plains claimed that the abortion provider has a constitutional right to transport minors across state lines for an abortion without parental consent.

“Our children deserve to be protected—not trafficked across state lines for dangerous and clandestine abortion procedures at the hands of an organization that has repeatedly demonstrated its utter contempt for the law, parental rights, and safety of the women and children of Missouri,” said Bailey. The attorney general went on to say that “Missouri parents have the fundamental right to know what medical procedures are being performed on their children”.

The filing is part of an ongoing legal challenge by Bailey alleging that Planned Parenthood Great Plains assisted Missouri minors in obtaining abortions in Kansas without parental consent and notification, in violation of section 188.250 RSMo. In its motion to dismiss the claim, Planned Parenthood disputes the factual allegations made by the attorney general. However, the filing states that even if Planned Parenthood transported minors out of state for abortions without parental consent and notification, such action is now constitutionally protected by the recently-approved Amendment 3.
